Prenuptial Agreement
There are many reasons that soon to be married spouses will consider a prenuptial agreement. Often times this is a second marriage and both spouses have children and assets that they would like to protect. Even for prospective spouses who have not been married before, it is something that one party may wish to have if that party has significant pre-marital assets. There must be a full disclosure of all assets and debt by both parties.
Postnuptial Agreement
Postnuptial agreements are rarer. They can be used when one spouse wishes to protect his or her assets from the other spouse who has suffered an economic set back.
Both parties should be represented by counsel in connection with either of these agreements.
